Terms of Service

By using High Score Math, you agree to these terms. In plain English: use the platform for its intended purpose (teaching and learning math), don't try to break it or misuse it, teachers vouch that they have the school's authority to add their students, and neither side gets to sue the other in court — disputes go to arbitration.

Please read the full terms below. They matter.

These Terms of Service (the "Terms") are an agreement between you and High Score Math ("we", "us", or "High Score Math"). By creating an account, joining a class, or otherwise using the platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the platform.

• Teachers must be at least 18 years old and using the platform to educate K-12 students. This includes classroom teachers authorized by a school or district, tutors, and homeschool parents or guardians teaching their own children.
• Students may create an account by signing in with a Google account, but the account is inactive — the student cannot use any part of the platform — until they join a class using a class code issued by their teacher. Meaningful participation only begins once a teacher has enrolled the student in a class.
• Under-13 students may use the platform when their teacher enrolls them in a class, on the basis of the school-directed consent model described in our Privacy Policy. If you believe an under-13 student created an account and joined a class without appropriate school authorization, contact us through the contact page and we will remove the account.

By signing up and adding students to a class on High Score Math, you (the teacher) represent and warrant that:

• You have the authority from your school, district, or equivalent educational institution to use online educational tools with your students.
• Your school has obtained any parental consents required by applicable law (including COPPA for students under 13, and any state-specific student data privacy laws) for the use of educational technology tools with your students, OR your school is exercising its authority to provide that consent on parents' behalf.
• You will use High Score Math for legitimate educational purposes only, and you will not share student names, class codes, or other student information with anyone who does not have a legitimate educational reason to see them.
• You may project the platform in your own classroom for your own enrolled students — for example, running a Live Game with the class. You will not share screenshots, screen recordings, or projections of the platform that reveal student names, scores, or other personal information with any wider audience (including social media posts, conference presentations, or public blog posts) without appropriate parental or school authorization.

You are responsible for keeping your account credentials secure and for all activity that happens under your account. Notify us immediately (via the contact page) if you believe your account has been compromised. We authenticate accounts through Google Sign-In and rely on Google's account security. We are not responsible for security issues that originate with your Google account.

You agree not to:

• Use the platform for anything other than legitimate math education
• Impersonate another teacher, student, or school
• Attempt to disrupt, overload, probe, scan, or attack the platform
• Circumvent any technical restriction, rate limit, or access control
• Scrape, harvest, or automate the collection of content from the platform
• Reverse engineer, decompile, or attempt to extract the source code of the platform except to the extent expressly permitted by law
• Use any content, data, output, or other information from the platform to develop, train, fine-tune, test, evaluate, align, or otherwise improve any machine learning algorithms or artificial intelligence models
• Upload malware, harmful content, sexually explicit content, or content that harasses, threatens, or bullies another user
• Use the platform to cheat, plagiarize, or misrepresent your work

High Score Math is intended to help students learn math. Using the platform to cheat on graded work — including by copying answers, sharing accounts, switching to another window to look up answers during a graded assessment, or asking another person to complete work on your behalf — is a violation of these Terms and of your school's academic integrity policies. Teachers can see basic integrity signals (like when a student switches away from the browser tab during an assessment) and may take action accordingly.

When a student submits an answer, uploads a photo of their handwritten work, or otherwise submits content to the platform, the student keeps ownership of that content. By submitting it, the student (through their school's authorization) grants us a limited license to store, display, and process that content for the purpose of operating the platform and showing it to the student's teacher.

When a teacher configures an assignment — picking skills, standards, question types, difficulty settings, due dates, and so on — the teacher is arranging High Score Math's own building blocks using the tools we provide. The configurations themselves are not independent creative works owned by the teacher; they are settings within our platform. All rights to the platform and its features remain with High Score Math.

Any comments, notes, or other free-text content a teacher writes (for example, a comment on a student's submission) remains the teacher's content, treated the same way as student-submitted content above.

The platform's software, question generators, curriculum organization, animations, and original artwork — including avatars, items, banners, treasure chest designs, achievement badges, and all other visual assets we've created — are owned by High Score Math and protected by copyright and other intellectual property laws. You may use the platform for its intended educational purpose. You may not copy, download (outside of features we've explicitly provided for that purpose), redistribute, sell, publicly display outside the platform, or make derivative works from our content except as expressly permitted by these Terms.

Certain third-party assets (Twemoji emoji graphics, Lucide icons, and others) are used under their respective open licenses. See the about page for attributions.

Coins, gems, treasure chests, cosmetic items, and any other in-app rewards (collectively, "Virtual Items") have no real-world monetary value. Virtual Items:

• Cannot be purchased with real money
• Cannot be transferred, traded, or sold between users or off the platform
• Cannot be converted to cash, other currencies, or anything of value outside the platform
• May be removed, forfeited, or reset if we detect abuse, cheating, or exploitation of bugs

We may add, remove, or adjust Virtual Items and the mechanics that produce them (including treasure chest drop odds) at any time.

We may suspend or terminate your access to the platform at any time, with or without notice, if we believe you have violated these Terms or if we determine we need to do so to protect the platform or its users. You may stop using the platform at any time, and you may request account deletion by contacting us through the contact page. Deletion timing and backup retention are described in our Privacy Policy.

To the fullest extent permitted by law, the platform is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any warranties of merchantability, fitness for a particular purpose, title, non-infringement, or that the platform will be uninterrupted, error-free, or secure. Your use of the platform is at your own risk.

To the fullest extent permitted by law, in no event will High Score Math, Nathan Charlton, or any related party be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, or business interruption, arising out of or related to your use of the platform, whether based on contract, tort (including negligence), warranty, or any other legal theory. Our total cumulative liability to you for any and all claims arising out of or related to the platform will not exceed one hundred U.S. dollars ($100), regardless of the cause of action.

You agree to defend, indemnify, and hold harmless High Score Math and its operator from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the platform, your violation of these Terms, or your violation of any rights of another party.

Please read this section carefully. It affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to the platform or these Terms (a "Dispute") will be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration will take place on a written-submission basis unless the arbitrator determines a hearing is necessary. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

You and High Score Math each waive the right to a trial by jury and the right to participate in a class action, class arbitration, or representative action. All disputes must be brought individually.

The seat of arbitration and the governing law is the State of California, USA, without regard to conflicts-of-law principles. Nothing in this section prevents either party from seeking injunctive relief in court for intellectual property infringement or similar claims that cannot practically be resolved in arbitration.

If you believe content on the platform infringes your copyright, contact us through the contact page with:

• Your contact information
• A description of the copyrighted work
• The URL(s) or specific location of the allegedly infringing content
• A statement, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf
• Your electronic or physical signature

We will respond to valid notices in accordance with the U.S. Digital Millennium Copyright Act. Repeat infringers will have their accounts terminated.

We may update these Terms from time to time. Substantive changes will be announced on the site with at least 30 days' notice before they take effect, and the "Last updated" date at the top of this page will change. Continued use of the platform after the effective date means you accept the updated Terms.
